									<p>Avec l’ajustement de la<strong> Loi énergie-climat</strong>, si vous êtes <strong>propriétaire loueur</strong>, il se peut que vous deviez faire des travaux dans votre logement si vous souhaitez continuer à le louer.</p><p>Si vous êtes <strong>propriétaire occupant</strong>, effectuer des travaux permettra d’alléger vos factures d’énergie et de valoriser votre bien, à terme, si vous avez comme projet de le vendre.</p><p>De ce fait, ceux qui ont des appartements mal notés ne pourront plus les louer (niveau G) ou verront le montant des loyers perçus gelé (niveau F). L’Etat les contraint donc à faire des travaux de mise aux normes afin d’obtenir une <b>note énergétique plus acceptable</b>.</p><p>Les <b>conséquences directes</b> qui découlent de ces nouvelles normes sont :</p><ul><li>La difficulté à vendre son bien si le DPE met en évidence une mauvaise classification énergétique</li><li>L&rsquo;impossibilité de mettre son bien en location</li><li>Le gel des loyers</li><li>La perte de la valeur du bien sur le marché, face à des programmes neufs ou des logements basse consommation.</li></ul><p><span style="text-decoration: underline;"><strong>La seule alternative reste la réalisation de travaux.</strong></span></p><p>On le sait, les banques ne prêtent pas au-dessus de 35% d’endettement, ce qui peut constituer un frein à vos projets de travaux et rénovation.</p><p>Afin de les effectuer, vous aurez plusieurs possibilités :</p>								</div>

									<ol><li><strong>Vérifiez votre offre de prêt,</strong> toutes les banques ne prévoient pas forcément le report partiel, total ou la modulation des mensualités. Il faut que ce soit inscrit dans votre contrat.<br />Si c’est bien prévu, alors nous vous conseillons d&rsquo;en <strong>vérifier les conditions</strong> : une ou plusieurs fois par an, ancienneté du contrat de prêt…</li><li>Mettez-vous en relation avec votre banquier afin de vérifier avec lui les modalités et surtout les <strong>répercussions sur le coût total de votre prêt</strong> en cas d’allongement de la durée de remboursement.</li></ol>								</div>

									<p>Le taux de l’usure correspond au taux maximum légal que les établissements de crédit sont autorisés à pratiquer lorsqu’ils accordent un crédit. Ce taux varie en fonction du type de prêts. Il est fixé à la fin de chaque trimestre pour le trimestre suivant par la Banque de France et publié au Journal officiel.</p><p><strong>Le but de ces seuils est de protéger l’emprunteur d’éventuels abus.</strong></p>								</div>

									<p>Le taux (ou le seuil) de l&rsquo;usure est le taux annuel effectif global (TAEG, anciennement TEG) maximal auquel un prêt peut être accordé. Un prêt est considéré comme usuraire lorsqu’il est consenti à un TAEG qui excède du tiers le taux effectif moyen pratiqué au cours du trimestre précédent.</p><p>Le TAEG est le taux auquel on se réfère pour apprécier si une offre de crédit dépasse le seuil usuraire. Il comprend :</p><ul><li>Le <strong>taux d&rsquo;intérêt </strong>(ou taux nominatif),</li><li>Les <strong>frais</strong>, <strong>commissions </strong>et <strong>rémunérations diverses </strong>(frais d&rsquo;inscription, frais de dossier, par exemple),</li><li>Et éventuellement des <strong>primes d&rsquo;assurance</strong> <strong>emprunteur</strong> lorsqu&rsquo;une assurance obligatoire est souscrite simultanément.</li></ul>								</div>

									<p>Avec la hausse des taux bancaire et la baisse du taux d’usure, cela va entrainer un effet ciseaux pour l’accession au crédit immobilier de certains ménages.</p><p><strong>Voici un exemple :</strong></p><p>Prenons un couple avec 50 000 € de revenus par an qui souhaite emprunter 230 000 € sur 20 ans avec 10% d’apport. Il se verront refuser le crédit au titre du dépassement du taux d’usure. En effet, avec un taux d’intérêt de 1.35%, auquel on rajoute le taux assurance à 0.3% (sur capital initial, 50% sur chaque tête), plus les frais de garantie et les frais de dossier. Nous avons un TAEG de 2.55%. Soit un TAEG supérieur au taux d’usure, ce qui entraînera donc un<strong> refus de prêt</strong>.</p>								</div>

									<p>Vu le contexte inflationniste qui s’installe et la tension sur les taux obligataires qui s’est intensifiée ces dernières semaines, les taux d’emprunts immobiliers vont continuer à augmenter en mars et très probablement en avril de 0,20 à 0,40 point.</p><p>Cependant pas de panique pour l’instant, les banques ont toutes des objectifs de production de crédit immobilier élevés : elles doivent donc limiter la hausse des taux. Les emprunteurs continuent de bénéficier de conditions favorables.</p><p>D’où l’intérêt de <b>vous faire accompagner par un courtier</b> pour négocier au mieux les conditions de financement !</p>								</div>
